High Price for flouting Environmental Regulations

Mr. Aditya Pratap appeared before the National Green Tribunal Principal Bench , New Delhi appealing against the grant of Environmental Clearance to a building project in Mumbai. The bench concurred with Mr. Aditya’s contention that Environmental norms were being flouted by the builder.

The bench levied a ₹3 crore penalty on the builder for constructing without Environmental Clearance and stopped any further construction till the regulations were met. The builder also had to deposit a sum over 32 lakhs to the Maharashtra Pollution Control Board for incurring expenses on Environmental and ecological rehabilitation.


Environmental clearance necessary even for minor extension

Mr. Aditya Pratap appeared before the National Green Tribunal Principal Bench , New Delhi appealing against the grant of Environmental Clearance to a building project in Mumbai. A stand for Regulation for Food prices

Mr. Aditya Pratap filed a PIL for allowing common citizens to outside food items into movie theatres and multiplexes, to which Maharashtra High Court inquired the government as to why the prices of food inside these institutions cannot be regulated instead.

Multiplexes violate the right to life under article 21 by denying citizens the liberty to carry their own food inside and pricing the food items sold inside at exorbitant high prices.

The Bombay High Court directed the Government of Maharashtra to frame a policy to allow cinemagoers to carry their own food inside multiplexes.


"Polluter Pays" for the Environmental Degradation

Mr. Aditya Pratap appeared before National Green Tribunal on behalf of a housing society members affected by the hill cutting in Lonavala and subsequent environmental degradation in the area without authorization.

Mr. Pratap evoked the ‘Polluter Pays’ principle and put forth the irregularities in the project in the construction process. The contentions were upheld by the NGT and the Respondent were ordered to pay a sum of Rs.40 Lakhs towards restoration of the area as well as the litigation cost for the suit

Calling out corruption: One plea at a time

Mr. Aditya Pratap has had a litany of cases where he called out corrupt practices operating in Real Estate industry, be it flouting Environment regulation or fake representation. In one such case Mr. Aditya Pratap appeared for an application to investigate into charges of corruption. The allegation was that the drainage certificate was granted without there being a any such facility and further issuing of false occupancy certificate.

Though it is difficult to trace the monetary indulgence in such cases the substance in the application was upheld and an investigative order was passed.


Financial Disability not an excuse for not providing basic amenities

Mr. Aditya Pratap,in a Writ Petition filed before the Bombay High Court brought attention to the Builder's non-observance in paying the water dues to the Municipal Corporation leading to a disrupted water supply to 128 slum dwellers.

The Builder was ordered to pay almost Rs. 9 Lakh in dues to the Municipal Corporation, in cash and was made to undertake to pay the future bills and not contend Financial restriction as a disability.
